basjoo design terms & conditions

General
These terms and conditions will apply to all transactions placed online with basjoodesign.co.uk/.com. Please read carefully before placing any order. All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights. By using this site you are agreeing to these terms and conditions'. All transactions with basjoodesign.co.uk/.com will be governed by these terms and conditions.

All references to the 'company', 'us' or 'we' will refer to basjoodesign.co.uk/.com. All references to the customer shall mean the person or persons purchasing or agreeing to purchase goods from the company. All references to the Web Site shall include reference to all URL's owned by basjoodesign.co.uk/.com.

Orders
We are pleased to accept orders by Online transaction (secure server). All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Switch and Solo. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. We are unable to accept or process any credit/debit card orders without a valid card payment in the name of the registered cardholder.

Price & Payments
All prices are shown in pound sterling (£). It is our policy to offer goods at the most reasonable price possible, however, if, due to circumstances beyond our control, we deem it necessary to alter any advertised price, we reserve the right to do so without prior notice.

Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions.

For larger orders over 10kgs we will contact and advise you of the extra costs when you place your order, at this point you may, if you wish, cancel your order and a full refund will be given.

All orders and any extra Bespoke or Courier costs must be paid in full before any work can commence on your order.

Delivery
All stationery orders placed with us are done so on the understanding that delivery dates are approximate and are subject to availability. We endeavour to deliver your order within 28 days from receipt, or in the case or Bespoke orders - from the date we receive your signed proof. Therefore for special occasion & wedding stationery orders we recommend you place an order with us at least 3 months prior to your occasion.

If we fail to deliver your order within the agreed timescale, or agreed date, for reasons within the reasonable control of us, Basjoo Design is deemed liable to you and our liability shall be limited to the value of the stationery order. If we fail to deliver your order within the agreed timescale, or agreed date, for reasons beyond the reasonable control of Basjoo Design, Basjoo Design shall not be deemed liable to you.

Delivery of stationery is always made through DHL couriers and includes DHL's insurance against loss or damage during transit, up to the value of the order. Please allow 3 working days for delivery. We reserve the right to deliver stationery through other carriers. Delivery of Art Prints is usually made through Royal Mail and sent Recorded Delivery.

Orders will require a signature on receipt, please ensure that there is someone to receive the order at your specified delivery address. Alternatively you may pre-arrange to collect your order or arrange for your own courier to collect from us, in which case you will be refunded our current courier charge.

Whilst we make every effort to pack your stationery and art print orders safely and securely we cannot be held liable for loss or damage whilst in transit or when the order has left our building via any other method.

For larger orders over 10kgs we will contact and advise you of the extra costs when you place your order. We can only ship within the UK at present.

Cancellations
Orders can be cancelled up to 48 hours after the order is placed. You will then be refunded to the amount of the cancelled items or order.

Refunds
We want you to be entirely satisfied with every purchase made from basjoodesign.co.uk/.com as we aim to offer you excellent quality, value and service at all times. However, because all orders are personalised with your individual details, refunds or reprints will only be made if the stationery is faulty or does not meet the specifications of your order. We do not offer exchanges or returns. This does not affect your statutory rights.

Faulty is classed as defects in printing, however, slight variations in colour cannot be classed as faulty.

If you think your stationery is faulty or does not meet your specifications, please contact us at studio@basjoodesign.co.uk for a 'postage paid' sticker & then return all faulty item/s via Royal Mail & with 'proof of posting' within 14 days of receipt. Returned items must be accompanied by a copy of your paid invoice and, where possible be accompanied by original packaging.

If we establish that the item(s) is/are faulty/don't meet the specifications on your order, we will re-print & re-deliver these items at no extra cost to yourself. If you are in any doubt, please contact us by sending an email to studio@basjoodesign.co.uk

Please double check and scrutinize your data being supplied as we cannot be held responsible for any errors in data supplied by you, to us, for personalisation. Any errors in data will result in reprint costs at your expense.

Complaints
Any complaint can be communicated directly to Basjoo Design. We will endeavour to deal with your complaint within three working days of receipt. In the event where we cannot resolve your complaint immediately we will advise a likely time scale to you and keep you informed of any investigation.

Privacy Policy
This privacy policy covers Basjoo Design, its Web sites, and any other method of selling. You can browse our site(s) without disclosing any personal data to us. Any links to third party web sites are covered by the third parties privacy policies. We do not automatically log personal data nor do we link information automatically logged by other means with personal data about specific individuals.

We will collect and store information about you to allow us to firstly, process and fulfill any order requirements and secondly to provide you with the best possible service. We will collect and store any personal data that you may volunteer whist using our services, e.g.(registration, placing an order or requesting a sample book). All information is collected lawfully and in accordance with the Data Protection Act 1998.

We will use the data for our own marketing purposes, including market research and to keep you up to date with any offers or information regarding our stores or direct sales channels.

Copyright
All artwork and designs are and will remain copyright of Basjoo Design. Any unauthorised use of the designs and material contained in our website(s) will be pursued vigorously.

Intellectual Property Rights
All copyright, trademarks and all other intellectual property rights in the service, the Website and its content (including without limitation the Website design, text, graphics and all software and source code connected with the Website and system) are owned or licensed by fresh:i and Basjoo Design or otherwise used by fresh:i and Basjoo Design as permitted by law.

In accessing the Website You agree that You will access the content solely for Your personal, non-commercial use. Other than any provided in these terms none of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without Our prior written consent.

Limitation of Liability
The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

To the extent permitted by law, Basjoo Design will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.

Basjoo Design makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Basjoo Design for death or personal injury as a result of the negligence of Basjoo Design or that of its employees or agents.

Force Majeure
We will not be liable for non-performances of our obligations caused or resulting from industrial disputes or any other circumstances beyond the reasonable control of the company such as act of God, riots, civil commotion, flood, fire and legislation. If by reason of such circumstances it shall become impossible within a reasonable time for the company to wholly or partly supply the items ordered then the customer's liability will be limited to the value of the items already supplied together with any associated delivery charges.
